Terms of Use & Consent Agreement (UK)

1. About These Terms

These Terms apply when you submit photographs, films or other content (“User Content”) to Watergate Bay Hotel Limited for possible inclusion in marketing materials including our website, social media channels, brochures, digital advertising and other promotional materials.

By submitting User Content, you confirm that you have read and agree to these Terms.

2. Grant of Licence

By submitting User Content, you grant Watergate Bay Hotel Limited a:

• worldwide

• royalty-free

• perpetual

• non-exclusive

• transferable and sub-licensable

licence to use, reproduce, edit, adapt, publish, translate, distribute and display the User Content in any media now known or developed in the future, including but not limited to:

• our website(s)

• social media platforms

• email marketing

You understand that your content may be edited for formatting, branding or promotional purposes.

3. Copyright & Ownership

You confirm that:

• You are the creator and copyright owner of the User Content; or

• You have full authority from the copyright owner to grant the above licence;

• The content does not infringe any third-party intellectual property, privacy or publicity rights.

You waive any moral rights (to the extent permitted under UK law) in relation to the use of the User Content by Watergate Bay Hotel Limited.

4. Personal Data & UK GDPR Compliance

Photographs and videos containing identifiable individuals constitute personal data under the UK GDPR and the Data Protection Act 2018.

Lawful Basis

We rely on consent as our lawful basis for processing personal data contained within User Content for marketing purposes.

By submitting content, you confirm that:

• You have obtained informed consent from every identifiable person featured in the content for it to be used for marketing purposes by Watergate Bay Hotel Limited; and

• Such consent covers online, social media and printed marketing.

5. Content Featuring Children (Under 18)

Where a child (under 18 years of age) appears in the User Content:

• You confirm that you are the child’s parent or legal guardian; or

• You have obtained explicit consent from the child’s parent or legal guardian for the specific marketing uses described in these Terms; and

• The parent/guardian understands the content may appear online and on social media platforms.

We reserve the right to request written parental/guardian confirmation before publishing any content featuring children.

We will not publish names or other sensitive identifying details of children.

6. Right to Withdraw Consent

Under UK GDPR, individuals (or parents/guardians on behalf of children) have the right to withdraw consent at any time.

If you or any person featured wish to withdraw consent, please contact:

Upon receiving a valid request:

• We will cease future use of the content;

• We will remove the content from platforms under our control within a reasonable timeframe;

• Withdrawal will not affect any use already undertaken prior to the request.

7. Data Retention

We will retain User Content for marketing purposes unless consent is withdrawn.

8. Content Standards

You must not submit content that:

• Is unlawful, defamatory, obscene or discriminatory;

• Depicts unsafe behaviour;

• Includes third-party branding without permission;

• Includes individuals who have not consented.

We reserve the right not to publish submitted content at our sole discretion.

9. No Payment

Unless expressly stated, submission of content is voluntary and no payment will be made for its use.
